MESA 24/7’s Privacy policy

The Privacy and Personal Data Protection policy is intended to inform how we collect, use, disseminate and/or reveal information we received through our Platform and other Services. Capitalized terms that are not defined herein shall have the meaning stated in our Terms and Use Conditions.

The Privacy and Personal Data Protection policy does not govern the use of any information you provide to us when you call us, write or communicate with us, other than through the Services. When using the Services, you agree to the provisions of the Policy hereof.


We collect your personal information and general information (as further defined by those terms):

"Personal Information" is information allowing us to identify you and/or what makes you identifiable, i.e. your name, last names, phone number, e-mail address, information of your location, credit card number, purchases and orders, among others. We receive information on credit card numbers and CVC codes encrypted, and it is stored by the payment gateways we work with (Culqi, Payu, among others).

You recognize and explicitly authorize us, by accepting the Privacy and Personal Data Protection policy hereof, to use and process all Personal Information you provide to us when using the Services, including but not limited to Personal Information obtained when:

a) Registering as a user in our Platform, b) Making reservations through the MESA 24/7 platform (web site and mobile App for iPhone and Android), the Widget of any of our affiliated restaurants (the Widget is a reservation button/engine installed by MESA 24/7 in the restaurant’s website and/or social networks, and/or partner companies’ website and/or social networks), and/or through the MESA 24/7 Network (integrations online that MESA 24/7 has with third parties to list restaurants and/or receive online reservations through their websites and mobile Apps). c) Entering or updating your profile in our Platform through your account or using a third-party access provider (for instance, Facebook and Google, among others). When doing this, you authorize each log-in service provider to send us the log-in information of your profile within your service, except for your password. d) Using the “Experiences” and/or “To Go” services. e) Participating in competitions, sweepstakes and special offerings. f) Participating in voluntary surveys, panels and market research, to which you have given consent. Information you provide in response to surveys’, panel’s or market research’s optional questions may be shared, but only in aggregated form with our advertisers and partners. g) Navigating in our Platform (cookies, IP address, beacons) to monitor the use of content.

Such Personal Information will be stored in our personal databases -except for your credit card number and CVC code, information we received encrypted and that is stored by the payment gateways- which have the necessary security measures and meet the highest protection standards. Furthermore, Personal Information shall only be shared with Restaurants, payment gateways and other third parties, as it may be the case, that are necessary for managing, developing and implementing Reservations at Restaurants, and processing payments made through our “Experiences” and/or “To go”, pursuant to applicable laws, and as provided in paragraph e) and f) above.

"General Information" refers to information that, by itself, does not allow identifying you (for instance, demographic information or web site visits). We may collect General Information received through any of the methods mentioned above, as well as automatically through standard technologies of the industry described below. For example, each time you visit the Services, your IP address, navigator and the type of equipment and access time may be collected automatically.


You recognize and accept that Personal Information is processed within the framework of the contract relationship we entered into. Furthermore, you authorize us to transfer your Personal Information to the Restaurants to manage, develop and implement the Reservations and payments for purchases at the Restaurants through the “Experiences” and/or “To/Go” features, as well as to send announcements, update services, offerings, invitations for sweepstakes, competitions and to send advertisements. In such events your data shall be stored in their computer systems. In that case, we ensure confidentiality and safe processing of information. Your Personal Information or General Information shall be used, including but not limited to the following cases:

a) System Management: We may use your General Information to manage our systems, for server troubleshooting assistance, to supervise our systems’ performance and traffic, and gather demographic information. From time to time, we will share dissociated or anonymized General Information with third parties, i.e. information not allowing the third party to identify or contact you personally.

b) Communication and Advertisement: We will use your Personal Information to periodically send you at your e-mail address and/or through SMS or any other available means, announcements, service updates, offerings, invite you to sweepstakes, competitions, send you our advertisement, and Restaurants’ and third parties’ advertisement. We may also send you through the same channels surveys on your Reservations, Services received and/or on any other issue of interest to ensure that your experience is improved. If you prefer not to receive any surveys or advertisement, you may request it sending a message to: Notwithstanding the abovementioned, you will receive e-mails related to Reservation management, “To Go” orders and “Experiences”, such as confirmations, non-attendance notices, details of consumption, fees charged when using the “Experiences” and/or “To Go” features, if there are any, and other similar information.

Moreover, as we indicated before, Restaurants may use Personal Information to send announcements, update services, offerings, invite you to participate in sweepstakes, competitions and send advertisement. We shall not be held responsible for e-mails you receive from the Restaurants. In the event you do not want to receive them, you shall directly contact the Restaurants.

c) Service Suppliers: In the event we decide to request the services of third parties, which involve your Personal or General Information (for example, data management and storage services), we shall transfer the necessary Personal or General Information required by the suppliers to deliver their services. In that event, the supplier shall commit to maintain confidentiality of information received or information it could have access to, including its employees and suppliers.

d) Other types of disclosure: Notwithstanding anything to the contrary included in this Privacy and Personal Data Protection policy, we reserve the right -and you hereby explicitly authorize us- to share your Personal or General Information: (1) in response to subpoenas, Court orders, or legal or administrative procedures of any kind, or to establish, protect or exercise our legal rights or defend ourselves against lawsuits, administrative procedures and investigations of any kind; (2) if we believe it is necessary to investigate, prevent or take action regarding potentially illegal activities, fraud or any situations that imply potential threats to safety of any persons or properties; (3) if we believe it is necessary to investigate, prevent or take actions against significant abuse of Service infrastructure or internet in general (such as, sending a large amount of spam, denial-of-service attacks, or attempts to compromise Information Security); (4) with affiliated companies or companies under common control with us, we will require them to honor this Privacy and Personal Data Protection policy; and (5) if we were acquired or merged with any other entity, and in the event of any corporate reorganization, sales of assets or bankruptcy.

e) Surveys: We may send you an e-mail and/or SMS, or use any other available means, to send you surveys on the Services we provide, or the services offered by the Restaurants and/or on any other subject of interest to improve our Services.


We continuously strive to provide you the best Service and thus we are constantly implementing new technologies and processes to better protect your Personal and General Information:

a) Security Measures. We shall adopt appropriate security measures to protect your Personal and General Information from non-authorized access, alteration, disclosure, loss or destruction under the parameters established by applicable laws on personal data protection. These mechanisms include but are not limited to, internal reviews of: (a) our data collection system; (b) storage and processing practices; (c) platform’s electronic security measures; and (d) physical security measures to protect our physical and virtual Personal and General Information Storage spaces from non-authorized access. Our employees, suppliers and agents with access to Personal Information are bound by confidentiality duties and obligations pursuant to applicable laws on personal data protection. The breach of such duties and obligations may result in disciplinary measures that include dismissal and paying a compensation, as the case may be, for unauthorized use or disclosure of Personal Information.

b) Links to third parties. We may have links to third parties who can collect your Personal Information and General Information. Furthermore, we may use third parties to provide components to our systems. In any event, third parties may have different privacy policies and their information collection practices will be independent from ours. We: (a) shall not be held responsible and have no obligation for third parties’ policies or actions; (b) we shall not be held responsible for such websites’ privacy policies or content; and (c) we make no warranties or representations with respect to the content, products or services offered in such websites or to the security of any Personal or General Information that you may give them.


We are committed to protecting children’s information, thus we encourage parents and guardians to play an active role in their children’s online activities and interests. The Services are not designed for children and may not be used by children under the age of 16. We do not knowingly collect Personal Information from children, and our Services are not intended for children under the age of 16.


You recognize that the Personal Data Privacy and Protection Policy are an integral part of our Terms of Use that governs access and use of Reservations and other Services. Our Services and the laws applicable to them may change and thus we reserve the right to update or amend this Personal Data Privacy and Protection policy at any moment. Therefore, we shall inform you of any amendments and shall require your consent regarding the new version of the Personal Data Privacy and Protection policy at any moment, in the event that any of the forms of processing you have authorized hereby changes. Notwithstanding, we recommend that you periodically review the Policy hereof, specially before providing additional Personal Information. This Policy was updated in the date stated at the end of the document herein.


To keep your Personal Information updated and complete, please communicate with us so that we adopt reasonable measures to update and correct it. Furthermore, you may exercise -at any time- your rights pursuant to the personal data protection laws into force, including your right to access, include, rectify, delete and oppose Personal Information you provided when accessing our Services.
